“I’m unsure about making a personal injury claim.” Is it the right thing to do?
Let’s be clear. If you have suffered a personal injury through no fault of your own and we establish you have a claim you are entitled to make it. In the vast majority of cases the other part will be insured. Insurance is usually a legal requirement. (e.g. for motor accidents.) However, insurance is a business like any other. You should not feel guilty for even considering seeking compensation. It is you that has suffered. We deal with all clients in a supportive and confidential manner. We often hear. “ I am glad I spoke to you as I had no idea I could claim back more than my out of pocket expenses.
It may only happen once to you. You only get one chance to claim. If you don’t, or at least don’t seek proper advice, and the effects of your accident continue for a long period of time, perhaps impacting on your ability to work, you won’t be able to turn the clock back!
How much will it cost me to make a claim?
How long will it take?
- Does the other party accept fault?
- Are they insured.
- How long ago did the accident happen and their records to confirm. (accident report / medical records.)
Most claims are dealt with via an online portal which gives the other parties deadlines to reply which speeds up the process. Most claims are settled well within 12 months however your case is as individual as you. We will discuss all factors involved and keep you updated as we proceed.
Can I only claim if it was non fault?
Is there a time limit to claim?
Who pays for my court fees or medical expert fees.
We do. Whilst they are your responsibility we will pay doctors’ fees, medical record fees and court fees for you. We will make sure that if you do not succeed these fees are covered by your own insurance which we will explain at the start.
If you win – these fees will be recovered from the losing party.
If you lose – they are funded by the insurer.
Sometimes we can obtain payment on account of you claim which can help fund these disbursements. If this option becomes available, we will advise you as we go.
