Not all marriages are successful – according to the Office for National Statistics 42% ended in divorce in 2012. It can be an extremely difficult time and there is a lot to consider. It is therefore important that you obtain the right advice.

Where a marriage comes to an end you may want to think about whether you should start divorce proceedings (or in the case of same sex couples, dissolve your Civil Partnership). There is just one ground for divorce in this country – that the marriage has irretrievably broken down. To show that this has happened you have to rely on one of the following:

  • Adultery

  • Unreasonable behaviour

  • Desertion over 2 years

  • 2 years separation with consent

  • 5 years separation where there is no consent

Tough decisions may need to be made regarding the children. Who will they live with? What financial support will be available?
