1. Falling off a ladder, when trying to hang some floor-to-ceiling sale banners inside a store window, after being told she’ll be fine.
Prior to the Accident
As a 19 year old, C had an operation to reconstruct an MPS ligament. Since then, C had enjoyed a healthy, active life, participating in 10K runs, attending the gym five times a week and enjoying range of dance activities from ballet, tap, modern and jazz.
Early one morning, her manager had instructed her to hang some floor-to-ceiling sale banners inside a store window. C stood at the top of tall ladders with the manager saying “Oh you’ll be fine”. Having reached over, C fell backwards off the ladder and landed on her right leg. It was extremely painful and by lunchtime she had to be taken home. Her leg was extremely swollen and having had an MRI scan, she was fitted with a brace.
After a twelve-week wait, and a consultant’s visit, the reason for the pain couldn’t be diagnosed and she was off work for a further seven months. She returned to work for light duties. Unfortunately, a slip on a step further exacerbated the knee problem.
Almost eighteen months after falling off the ladder, C returned to the consultant and at this point the reason for the pain was finally diagnosed; the fall had dislodged a piece of metal (positioned during the operation she’d had as a nineteen year old) from her knee and this had become embedded in her scar tissue. This in turn, needed an operation to remove the metal and scar tissue.
Life after the Accident
C is now registered disabled and her medical condition will result in continuing problems for the rest of her life, including arthritis. She says each day is unpredictable, “Some days I can’t get out of bed”, “I’m lucky to walk some days” and “I’ve learned to live with pain.”
The Manners Pimblett Experience
“I cannot give enough praise about how I was treated.” Having been supported by Manners Pimblett, C states that she was made to feel very welcome, and if “I didn’t understand something, Greg (Hall) took the time to make sure I left with a full understanding. He never hid anything, was very honest and always gave me options.” C says that she was always made aware of the potential outcomes and Greg brought everything back to basics so that she could understand the law. She continues, “He always had time to speak to me and I didn’t feel just like another number. He really fought on my behalf.”
The compensation she received has enabled her to set up her own business, meaning she can work from home.
2. Missing Grid Claims ‘Case Study’ – Claimant receives personal injury compensation despite council defending claim.
Below is a case study / note from one of our solicitors here at Manners Pimblett about a trial he has recently won, thanks to sheer determination and assistance from the local residence the client received the compensation she deserved.
Miss D suffered a nasty accident when her leg went down an uncovered grid in Stockport. The lighting nearby was poor, and so she did not notice that the grid cover was missing as she crossed the road. It later turned out that a number of grid covers in the area had been stolen, and that the Council were aware of this, but they had placed traffic cones over them as a precautionary measure. The Council deemed this sufficient action to warrant defending the claim as far as trial.
The Claimant succeeded at trial, partly due to the fact a number of local residents were willing to testify that there had been a series of grid thefts in the area, and that the temporary traffic cones that had been placed over the drains were being moved or knocked over, thereby leaving the grids exposed again. The Claimant was awarded significant damages for what was a permanent injury to her leg.
